Acceptance of Terms

By accessing or using the Duarte Deck & Fence website at duartedeckandfence.com, or by engaging our services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use our website or engage our services.

These Terms and Conditions apply to all visitors to our website and to all clients who engage Duarte Deck & Fence for services. They form part of any service agreement between you and us unless a signed written contract expressly states otherwise.

Description of Services

Duarte Deck & Fence provides residential deck construction, fence installation, and related outdoor structure services in Duarte, CA and surrounding communities in the San Gabriel Valley. Our services include but are not limited to custom deck design and build, composite and wood deck installation, deck repair, vinyl and wood fence installation, pergola installation, patio covers, and related outdoor living structures.

We reserve the right to decline any project request at our sole discretion and without explanation. Submission of a contact form or estimate request does not constitute a contract or obligation on our part to perform services.

Estimates and Pricing

All project estimates provided by Duarte Deck & Fence are based on information available at the time of the estimate. Estimates are not guaranteed final pricing. Final pricing is set forth in a written contract signed by both parties before work begins.

Estimates may change if site conditions, scope of work, material costs, or permit requirements differ from what was represented or assumed at the time of the estimate. If any change would affect the project price, we will notify you in writing before proceeding with the affected portion of work.

Verbal representations about pricing are not binding. Only written, signed contracts establish the agreed price for services.

Scheduling and Cancellation

Scheduling for site consultations, permit submissions, and construction work is subject to availability. We will make reasonable efforts to accommodate your preferred timeline, but we cannot guarantee specific start or completion dates due to factors outside our control, including permit processing times, weather, material availability, and prior project commitments.

Once a signed contract is in place and a start date has been established, cancellations must be made in writing. Cancellation terms, including any applicable cancellation fees or deposit refund policies, will be set forth in your individual service contract. If you cancel after materials have been ordered or permit fees have been paid on your behalf, you may be responsible for those costs.

Payment Terms

Payment terms, including deposit amounts, progress payment schedules, and final payment due dates, will be specified in your signed service contract. No work will begin until a signed contract and any required deposit are received.

Final payment is due upon substantial completion of the project. Withholding final payment based on minor punch-list items that do not affect the use of the structure is not permitted. We will address reasonable punch-list corrections promptly after final payment.

Overdue payments may be subject to interest and collection costs as specified in your contract. Failure to make timely payment may result in suspension of work.

Permits and Compliance

Duarte Deck & Fence will obtain required building permits for construction projects as part of our service. Permit fees are either included in the quoted price or invoiced separately, as stated in your contract. You agree to cooperate with permit requirements, including providing access to your property for required inspections.

You are responsible for ensuring that any homeowners association (HOA) approvals required for your project are obtained before construction begins. We are not responsible for delays or costs resulting from HOA review processes.

Warranty Disclaimers

Duarte Deck & Fence warrants that our workmanship will be free from material defects for a period of one year from the date of substantial completion, subject to normal use and proper maintenance. This warranty covers defects in our labor and installation. It does not cover damage from misuse, neglect, acts of nature, normal wear and tear, or modifications made by anyone other than Duarte Deck & Fence.

Materials and products installed as part of your project may carry separate manufacturer warranties. We will provide you with applicable manufacturer warranty documentation at project completion. Manufacturer warranties are governed by the manufacturer's terms, not ours.

Except as stated above, Duarte Deck & Fence makes no express or implied warranties regarding our services or any work product. To the maximum extent permitted by applicable law, all implied warranties are disclaimed.

Limitation of Liability

To the maximum extent permitted by California law, Duarte Deck & Fence's total liability to you for any claim arising from our services or these Terms shall not exceed the total amount paid by you to us for the specific project giving rise to the claim.

In no event shall Duarte Deck & Fence be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of use, loss of profits, or property damage beyond the scope of the project itself, even if we have been advised of the possibility of such damages.

This limitation does not apply to claims arising from gross negligence, willful misconduct, or fraud.

Website Use

The content on the Duarte Deck & Fence website is provided for general informational purposes only. We make reasonable efforts to keep information accurate and up to date, but we do not warrant that all content is free from errors. We reserve the right to change or remove website content at any time without notice.

You may not use our website for any unlawful purpose, to transmit harmful or disruptive content, or to attempt unauthorized access to any part of our systems.

Dispute Resolution

We encourage you to contact us directly to resolve any concerns or disputes before pursuing formal proceedings. Most issues can be resolved quickly through direct communication.

If a dispute cannot be resolved informally, the parties agree to attempt resolution through non-binding mediation before initiating any formal legal proceeding. The costs of mediation will be shared equally unless otherwise agreed in writing.

Any unresolved dispute shall be subject to binding arbitration or litigation as specified in your signed service contract, or as otherwise required by California law.

Governing Law

These Terms and Conditions and any disputes arising from your use of our website or our services are governed by the laws of the State of California, without regard to its conflict-of-law provisions. You consent to the exclusive jurisdiction of courts located in Los Angeles County, California for the resolution of any disputes that proceed to litigation.

Modifications to These Terms

Duarte Deck & Fence reserves the right to update these Terms and Conditions at any time. Changes will be posted on this page with an updated effective date. Your continued use of our website or services after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
